Abstract

The new procedural institution was introduced to the Code of Administrative Procedure. If all the parties make the appropriate request, the appeal authority will have to conduct the explanatory proceedings, regardless of its scope. The purpose of the new legal regulation is to reduce the number of cassation decisions issued by the appeal authorities. However, there is a high probability that the effectiveness of these regulations will be low.
