Podmiotowość prawna w sferze prawa administracyjnego : w poszukiwaniu kryteriów jej ustalania

Abstract

A human being (a physical person) is always the subject of administrative law, however administrative law does not always give a status of the subject to a single person — it will be often different types of forms of collaboration between individuals, of a varying form of their organisation. In order to properly emphasise the administrative and legal subjectivity of a human, and, in particular, to make it a subject of due legal protection, it is necessary to undertake further research enabling identification of forms of organisation other than a human being (a physical person), which may be attributed to subjectivity. While looking for criteria which may be helpful for this purpose, one need to refer to legal structures developed with the doctrine, in particular to ‘administrative law case’.
