Postępowania w sprawie organizacji i zakazu imprezy artystyczno-rozrywkowej na podstawie ustawy o organizowaniu i prowadzeniu działalności kulturalnej

Abstract

The organization o f artistic - entertainment events on the basis o f the law on organizing and conducting cultural activities requires a notification to correct commune administrator (mayor, president). The organ must be informed o f a future event, as it he can pursue granted competence from the scope preventive control of such events. The submission of notice, therefore doesn’t initiate administrative proceedings to issue a decision authorizing the organization o f the event, however, can result in ex officio initiation of proceedings to issue a decision on the prohibition the organization. The organization of artistic and entertainment events from the formal point of view is associated with two types of silence of organ: in front of the administrative procedurę and in progress but effects are different character, from the formal point o f view it is associated with a twofold silence o f the organ: in front o f the administrative procedure and in its progress, and its effects are different in nature.
