Prawo autorskie w odniesieniu do zbiorów specjalnych : refleksje badacza literatury dawnej

Abstract

The article discusses the problems of intellectual property in relation to old printings and manuscripts. The proprietary copyrights to these o works of literature aren’t valid but personal copyrights still exist. In past centuries the problem of plagiarism or the rights of the creators of the anthologies were considered differently. For example, the editors did not include personal data on the title page or authors were using pseudonyms. The paper presents a few examples showing the diffi culties in defi ning the correct subject of the copyright. It signalizes the need of the correct citation of the old printings and suggests a list of the most precious manuscripts that should be available on the Internet. In recent editions of the old writing works of art, the personal and proprietary copyrights belong to the editors who should respect and document well the work of their predecessors (by the correct editing of the scope notes). Nowadays access to the unique books and manuscripts is facilitated by digital libraries but it is a relevant to indicate the author and the characteristics of the works of art. The critical editions are usually not available in digital repositories because of the validity time of the editors’ proprietary copyrights.
