Mediacja jako nowa instytucja w procedurze administracyjnej

Abstract

The amendment of the Code of Administrative Procedure, which entered into force on 1 June 2017, is currently being discussed by many entities not only directly connected with the administration, such as public administration bodies or the departments of law and administration of Polish universities, but also entrepreneurs or „ordinary” citizens. Public debate is about the revolutionary changes that this regulation is about. This article discusses the subject of mediation, which introduced in chapter 5a of the amended version. This is undoubtedly important subject, because until now mediation proceedings in the administration were only in court‑administrative proceedings, while the draft amendment of the Supreme Administrative Court. It envisages that mediation proceedings may take place already at the stage of administrative proceedings.
