Abstract

A legal obligation has been in force for 35 years for spatial planning providing the protection of mineral deposits by creating opportunities for their extraction. in practice, however, this has been executed to an extremely modest extent and it is not uncommon that spatial plans either preclude any mineral exploitation or make it considerably more difficult. Although the Geological and Mining Law provides instruments to enforce the imple-mentation of this kind of deposits protection, they are still disregarded. This problem had been ignored in some initial administrative court judgements, yet in their recent judgements, the administrative courts are recognizing the need for such protection.
