Abstract

The problem of compensation of costs of cleaning up the road after a traffic accident by the insurer of motor third party liability insurance is of great importance for the polish jurisprudence. The authors present two different lines of case law in this matter – the first one recognizing the liability of the civil liability insurer and the second one dismissing the claims for damages. In the authors’ view, insurers are not obliged to reimburse the costs of removing the remains after an accident and cleaning up the road.
