Abstract

In the history of military proceedings, the evolution of the procedural position of the prosecutor before a military court takes a significant place. It attests not only to the genesis and specifics of this type of criminal process, but also to the tendency for military standards to become similar to universal rules. The independence of the prosecutor, or the lack of it, in relation to military aspects/factors pointed out to the fact of who was the de facto holder of prosecutorial powers, and what purpose was served by the military judiciary. What characterises the interwar period is the predominance of the military factor. The process of Polish military prosecutor, considered as a participant in the military criminal process, developing subjectivity has been completed in the context of the legal framework of the second half of the twentieth century.
