Abstract

Abuse by authorities of cassation appeal the decision to issue (art.138§ 2 C.A.P.) causing the increase in the duration of administrative proceedings resulted in the need for change in this area. The amendment of the Code of Administrative Procedure, introduced by the Act of 9 April 2017 on the amendment of the Act – Code of Administrative Procedure and some other acts introduced in this respect new regulations in the form of binding recommendations of the second instance authority and opposition to the administrative court initiating the proceedings of a single instance and incidental.
