Abstract

The prerequisite for the Author’s considerations presented in this elaboration was the resolution adopted by the Second Countrywide Meeting of the members of Polish Prosecutors Association held on 25 May 2002 on the Prosecutors Ethic Rules Collection. The author prepares a detailed characteristic of prosecutors ethic rules based on the bill of 20th June 1985, and other legal acts in power. In particular, the author tackles the problem of the ethic requirements which are to meet by a person in the position of prosecutor. He also tries to interpret the notion of “Immaculate character” in terms of the prosecutor’s ethic rules. The next problem undertaken in his considerations concerns the prosecutor’s observance of ethic rules in terms of civil service hierarchy and subordination on which the prosecutor’s office is based. When analysing the prosecutor’s ethic rules, the Author stresses that he is a civil servant, and the Prosecutor’s Office is a body to whom the judiciary has entrusted the function of Public accuser. Therefore an inevitable question arises whether a collision of ethic rules binding the prosecutor and the legal rules of law in power is possible and how it should be judged. In that aspect the author compares also “The Collection of Prosecutor’s Rules of Ethics“ with ethical rules of other legal professions. The Author also poses a question if the “The Collection of Prosecutor’s Rules of Ethics“ is necessary and what doubts it may imply in the future. Finally, in the scope of the analysis carried out, the Author tackles the problem of the prosecutor’s office role and the prosecutor’s profession ethic rules in shaping the ethics of the prosecutor’s profession in shaping the ethics in business life, particularly shaping the ethical business.
