Abstract

The object of this publication is the analysis of A rticle 96 of the Act of 27 April 2001 on Environmental Protection Law in terms of practical application of this legislation in Poland compared with Lesser Poland Regional Assembly adopting the resolution of 25 November 2013 no. XLIV/703/13 on determining the types of fuels approved for use in the area of the Municipality of C racov. In addition, the paper includes a reference to the judgment of the Regional Administrative Court in C racov on the ref. Act II SA/Kr 490/14 which was passed as a result of the appeal of the above-mentioned resolution. The paper also contains a reference to the proposed changes to Article 96 of the Environmental Protection Law Act.
