Postępowanie kwalifikacyjne w prawie geologicznym i górniczym

Abstract

The aim of qualification procedure is to exclude such entrepreneurs applying for licenses for exploration and exploitation of hydrocarbons who are connected in the way that may endanger the State security, as well as those not experienced enough. The final phase of such procedure is the decision of the license authority (Minister of the Environment) considering the applying entrepreneur as “qualified” or not. Only “qualified entrepreneur” may bid (take part in a tender) for a hydrocarbon license. After obtaining the license the above procedure must be repeated every 5 years. Nevertheless, if the connection of the “qualified entrepreneur” changes endangering the State security, the decision shall be revoked. When such entrepreneur is no more “qualified”, its license shall be withdrawn.
