| Abstract: | The article justifies the viewpoint that carrying out the policy of social benefits, which is a specificby-law affecting the legal situation of citizens, may be consistent with the principle of the democraticrule-of-law state in a formal and material aspect. The considerations include, among others,the principles of the rule of law, sources of law, law binding upon the administration, administrativediscretion and its control, as well as the specificity of decisions taken on matters concerning socialassistance. |
