| Abstrakt: | In the article the author presents the Article 115 ust. 1 of Act of 4 February 1994 on Copyright and Related Rights as a protection measure from infracting authors moral rights. He especially focuses on the identification of the proper legal good which is protected by this rules. Such identification is necessary to determine the scope of criminalisation. The author also analyses the features of an offence having regard to all interpretation problems attached. He also considers the rationality of the criminalisation of plagiarism. |
