Abstrakt: | The limits of an appellate measure constitute a fundamental factor influencing the examination of a matter in models with a reduced scope of appellate control. The quantity and type of its constituents are interpreted in a highly diverse manner. Article 433 § 2 of the Code of Criminal Procedure (k.p.k.) appears to be a solution to the question of ambiguity of the said disputable notion. The elements contained therein that are subject to obligatory control in the appellate instance are treated as a definition of the limits of an appellate measure. As per Article 433 § 2 of k.p.k., the controlled elements comprise accusations and appellate motions, but the enumeration lacks an unquestionable constituent of the limits, which is the scope of appeal. A list of controlled elements is only a fragmentary list of designations of the limits of an appellate measures. Article 433 § 2 of k.p.k. does not eliminate the question of ambiguity of the disputable notion. Likewise, the list of controlled elements does not include expressions typical for a legal definition. The legal provisions that have been in effect since 1 July 2015 do not include the disputable notion. It has been replaced by a criterion indicating the questioned extract of the judgment and default of the governing body. |
